Provider Terms of Service

1. Introduction & Acceptance

QuoteMe is a quote comparison platform that connects consumers with service providers. These Provider Terms of Service ("Provider Terms") govern your use of the QuoteMe platform as a service provider.

By creating a provider account on quoteme.website, you agree to be bound by these Provider Terms as well as our general Terms of Service. If there is a conflict between these Provider Terms and the general Terms of Service, these Provider Terms will take precedence with respect to your use as a service provider.

Please read these terms carefully before registering as a provider. If you do not agree to these terms, you may not use the platform as a service provider.

2. Eligibility

To register as a service provider on QuoteMe, you must meet the following requirements:

  • You must be at least 18 years of age.
  • You must have the legal authority to enter into binding contracts.
  • You must have the legal right to provide the services you offer on the platform.
  • You must comply with all applicable local, state, and federal laws and regulations related to your services.
  • You must provide accurate and truthful business information during registration.

3. Provider Account & Registration

To create a provider account, you must provide the following information:

Required Information

  • Business name
  • Owner name
  • Phone number
  • Email address
  • Business address
  • Service categories

Optional Information

  • License number
  • Insurance certificate
  • Business logo
  • Business bio / description

Email verification is required to activate your account. Your account is subject to review and approval by QuoteMe. You are responsible for maintaining accurate and current account information at all times. Only one account is permitted per business entity.

4. Credit System & Fees

  • QuoteMe uses a credit-based system for provider services.
  • Connection fees are charged in credits when a customer selects your quote.
  • Connection fee amounts vary by service category and are displayed before you submit a quote.
  • Credits can be purchased via prepaid packages. Pricing is available on the platform.
  • Credits are non-transferable between accounts.
  • QuoteMe reserves the right to modify credit pricing and connection fee amounts with 30 days advance notice.
  • Beta Program: During the beta period, promotional credits may be provided at no charge. See Section 16 for beta-specific terms.

5. Quote Submission

  • Providers may submit one quote per service request.
  • Quotes are estimates only and do not constitute a binding contract between you and the customer.
  • Quotes should be made in good faith and reflect a reasonable estimate of the actual cost.
  • QuoteMe operates a blind bidding system: you cannot see other providers' quotes.
  • Customer contact information is NOT visible during the quoting process.
  • You may include: pricing (flat rate, range, hourly, or inspection-only), estimated timeline, warranty information, notes, and exclusions.
  • Submitting false, misleading, or intentionally inaccurate quotes is prohibited.

6. Connection & Contact Information Sharing

  • A "Connection" is created when a customer selects your quote.
  • Upon Connection, a connection fee (in credits) is deducted from your balance.
  • Customer contact information is shared with you ONLY after a Connection is created.
  • The specific contact information shared depends on the customer's preference (email, phone, or both).
  • You must contact the customer promptly after receiving their information.
  • Connections are logged and auditable.

7. Refund Policy

  • Connection fees are generally non-refundable once a Connection is created.
  • QuoteMe may, at its sole discretion, issue credit refunds in certain circumstances, including but not limited to: fraudulent or spam requests, or customer non-responsiveness.
  • Refund requests are subject to review by QuoteMe.
  • QuoteMe reserves the right to limit refund eligibility for accounts with excessive refund requests.
  • Abuse of the refund system may result in account suspension.

8. Provider Obligations

As a service provider on QuoteMe, you agree to:

  • Provide accurate business information and keep it updated at all times.
  • Respond promptly to customers after a Connection is made.
  • Provide services in a professional and competent manner.
  • Maintain all required licenses, permits, and insurance for your service category.
  • Comply with all applicable laws, including labor, safety, and consumer protection regulations.
  • Not discriminate against customers based on race, color, religion, sex, national origin, disability, or other protected characteristics.
  • Report any safety incidents or customer complaints to QuoteMe.
  • Maintain adequate liability insurance coverage (recommended).

9. Prohibited Conduct

The following actions are strictly prohibited and may result in immediate account suspension or termination:

  • Platform circumvention: Soliciting customers to transact outside of QuoteMe to avoid connection fees. This includes providing contact information in quotes, requesting customers contact you directly, or offering discounts for off-platform transactions.
  • Data misuse: Selling, sharing, renting, or otherwise distributing customer personal information obtained through QuoteMe to any third party. Violation results in immediate account termination, forfeiture of all credits, and QuoteMe reserves the right to seek damages on a per-incident basis.
  • False information: Submitting misleading quotes, fake reviews, or inaccurate business information.
  • Spam or harassment: Sending unsolicited communications, harassing customers, or engaging in aggressive marketing tactics.
  • Multiple accounts: Creating or operating multiple provider accounts for the same business.
  • Unauthorized brand use: Claiming endorsement, certification, or partnership with QuoteMe. You may state that you are "available on QuoteMe" but may not imply QuoteMe endorses, certifies, or guarantees your services.

10. Customer Data Usage & Retention

  • Customer data obtained through QuoteMe may ONLY be used for the specific service transaction for which the Connection was made.
  • You must NOT use customer data for marketing, solicitation, or any purpose unrelated to the connected service request.
  • You must NOT add customers to mailing lists or marketing databases.
  • Data retention: You must delete or securely destroy all customer personal information within 90 days after the service transaction is completed or cancelled, UNLESS a warranty period applies, in which case you may retain data for the duration of the warranty.
  • You must implement reasonable security measures to protect customer data in your possession.
  • In the event of a data breach involving customer information obtained through QuoteMe, you must notify QuoteMe within 48 hours.

11. Licensing & Insurance

  • For service categories that require professional licenses by law (e.g., moving companies requiring USDOT numbers, contractors requiring state licenses), you MUST maintain valid, current licenses.
  • QuoteMe may request proof of licensing at any time, and failure to provide it may result in account suspension.
  • For all other categories, appropriate licensing and liability insurance are strongly recommended but not required.
  • You represent and warrant that you hold all licenses, permits, and authorizations required by applicable law to provide your services.
  • QuoteMe does not verify the validity of licenses or insurance and disclaims liability for providers operating without proper credentials.
  • This policy applies equally to all current and future service categories on the platform.

12. Platform Role & Disclaimer

  • QuoteMe is a marketplace intermediary only; we do not employ providers or control how services are performed.
  • Providers are independent contractors, not employees, agents, or representatives of QuoteMe.
  • QuoteMe does not guarantee: volume of requests, number of connections, revenue, or any specific business outcomes.
  • Any disputes between providers and customers regarding service quality, pricing, scheduling, or scope of work must be resolved directly between the parties. QuoteMe will not mediate or intervene.
  • THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.
  • QUOTEME'S TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT OF CREDITS YOU HAVE PURCHASED IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Intellectual Property & Brand Usage

  • The QuoteMe name, logo, and all platform content are QuoteMe's exclusive property.
  • Permitted: You may state "Available on QuoteMe" or "Find us on QuoteMe" in your own marketing materials.
  • Prohibited: You may NOT use "QuoteMe Certified," "QuoteMe Approved," "QuoteMe Partner," or any language implying endorsement or certification by QuoteMe.
  • You may not use the QuoteMe logo without prior written permission.
  • Content you submit (quotes, business descriptions, photos) remains your property, but you grant QuoteMe a non-exclusive, royalty-free license to display it on the platform.

14. Account Suspension, Termination & Credits

QuoteMe may suspend or terminate your account for: violation of these terms, fraudulent activity, excessive customer complaints, sustained low ratings, extended inactivity (24+ months), or at QuoteMe's reasonable discretion.

Voluntary Termination

You may deactivate your account at any time. Purchased credits (minus applicable processing fees) will be refunded. Beta or promotional credits are forfeited upon voluntary termination.

Termination for Cause (TOS Violation)

All credits (purchased and promotional) are forfeited. No refund will be issued. QuoteMe reserves the right to pursue additional remedies.

Termination Without Cause

Purchased credits (minus applicable processing fees) will be refunded. Beta or promotional credits are forfeited.

Upon termination, you must immediately cease using QuoteMe and delete all customer data in your possession. Account deactivation (self-service) hides your profile but preserves your data; reactivation is possible by signing back in.

15. Dispute Resolution

Informal Resolution First

Before filing any formal proceeding, you agree to contact QuoteMe at support@quoteme.website and attempt to resolve the dispute informally for at least 30 days.

Small Claims Court

Either party may bring qualifying claims in small claims court in the county where you reside or in Orange County, California, if the claim is within the court's jurisdictional limit.

Binding Arbitration

Any dispute not resolved informally or through small claims court shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted in English in Orange County, California, or remotely as agreed by the parties.

Class Action Waiver

You agree to resolve disputes with QuoteMe on an individual basis only. You waive any right to participate in a class action, collective action, or representative proceeding.

Exceptions

Intellectual property disputes and injunctive relief requests may be brought in court.

16. Beta Program Terms

  • During the beta period, QuoteMe may provide promotional credits at no charge.
  • Beta credits are subject to expiration when the beta program ends, with reasonable advance notice.
  • Beta features may be modified, suspended, or discontinued at any time without notice.
  • No service level agreement (SLA) applies during the beta period.
  • QuoteMe provides no guarantees regarding platform availability, uptime, or feature completeness during beta.
  • Your participation in the beta does not guarantee continued access to any features or pricing after the beta period ends.
  • Beta feedback: By providing feedback during the beta, you grant QuoteMe the right to use that feedback without restriction.

17. Changes to Terms

  • QuoteMe may modify these Provider Terms at any time.
  • Material changes will be communicated via email at least 30 days before they take effect.
  • Non-material changes (e.g., formatting, clarifications) may take effect immediately.
  • Your continued use of the platform after changes take effect constitutes acceptance.
  • If you do not agree with the updated terms, you must stop using the platform and may request account termination.

18. Governing Law

These terms are governed by the laws of the State of California, without regard to conflict of law principles. The English language version of these terms is the legally binding version.
